1. Acceptance of Terms

By accessing or using cbcedukenya.com (the "Website") or purchasing any product from us, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Website or place an order.

These Terms apply to all visitors, buyers, and users of the Website. We reserve the right to update these Terms at any time. Continued use of the Website after changes constitutes acceptance of the revised Terms.

CBC Edu Kenya ("we", "our", "us") operates cbcedukenya.com, an online platform selling digital educational materials for Kenyan learners, teachers, and parents. We are based in Kenya.

3. Products & Descriptions

All products on cbcedukenya.com are digital downloadable files (PDF format unless otherwise stated). No physical goods are shipped.

We make every effort to ensure product descriptions are accurate. Our materials are:

Original works created by CBC Edu Kenya
Aligned with the Kenya Institute of Curriculum Development (KICD) Curriculum Designs for CBC
Aligned with Cambridge Assessment International Education syllabi for IGCSE/Cambridge materials
Not officially endorsed, approved, or certified by the Kenya Ministry of Education, KICD, or Cambridge Assessment International Education unless explicitly stated

We reserve the right to update, modify, or discontinue any product at any time without notice.

4. Ordering & Account

You do not need to create an account to purchase from us. Orders are processed on a guest basis. By placing an order, you confirm that:

You are at least 18 years old, or are purchasing with the consent of a parent or guardian
The information you provide (name, email, phone number) is accurate and complete
You are authorised to use the payment method provided

We reserve the right to cancel or refuse any order at our discretion, for example in cases of suspected fraud, pricing errors, or material unavailability.

Order confirmation will be sent to the email address you provide. Please ensure your email address is correct before completing your purchase.

5. Payments

We accept the following payment methods:

M-Pesa (primary) — via Safaricom Daraja STK Push. Payment is processed directly by Safaricom. We receive only a transaction confirmation number.
Visa / Mastercard — processed by Stripe, Inc. (PCI-DSS Level 1 certified). We do not store card details.
PayPal — processed by PayPal Holdings, Inc. You will be redirected to PayPal's secure checkout.

All prices are displayed in Kenyan Shillings (KSH). International payment methods (Stripe, PayPal) may apply currency conversion charges which are outside our control.

Payment is due in full at the time of purchase. We do not offer credit or instalment plans unless explicitly stated.

If a payment fails or is declined, your order will not be confirmed and no download links will be issued. Please try again or use an alternative payment method.

6. Downloads & Delivery

Upon successful payment, you will receive:

A download link sent to your registered email address
Access to the download from your order confirmation page

Download links are:

Valid for 365 days from the date of purchase
Limited to 5 download attempts per file
Secured with HMAC-signed tokens — links cannot be shared or transferred

If you experience problems downloading your files, contact us within 7 days of purchase at cbcedukenya@gmail.com or via WhatsApp. We will investigate and, where the fault lies with us, reissue the download link.

We are not responsible for:

Files deleted from your device after download
Loss of access due to expiry of the download link after 365 days
Download failures caused by your internet connection, device, or browser
Expired download links where you failed to download within the validity period

7. Licence to Use

When you purchase a product from CBC Edu Kenya, we grant you a personal, non-exclusive, non-transferable licence to:

Download and save the file to your personal device(s)
Print copies for your own personal or classroom use
Use the materials for teaching, studying, or personal educational purposes

This licence does not permit you to:

Resell, redistribute, sublicence, or share the files with others (including posting online)
Upload our materials to any file-sharing platform, group, or website
Claim authorship of our materials
Remove, alter, or obscure any copyright notices or branding
Use our materials for commercial purposes without prior written agreement
Create derivative works for commercial distribution

School/Institutional Licences: Schools and institutions wishing to use our materials for multiple teachers or classrooms should contact us to discuss a bulk licence agreement. Single purchases are for individual use only.

8. Intellectual Property

All content on cbcedukenya.com — including but not limited to text, images, graphics, product files, lesson plans, schemes of work, examination papers, assessment rubrics, and study guides — is the intellectual property of CBC Edu Kenya or our content creators, and is protected by Kenyan and international copyright law.

The KICD Curriculum Designs are the intellectual property of the Kenya Institute of Curriculum Development. Our materials are original works inspired by and aligned with those curriculum designs — they are not reproductions of official KICD documents.

Cambridge syllabi, assessment criteria, and past papers are the intellectual property of Cambridge Assessment International Education. Our Cambridge/IGCSE materials are original revision notes and study guides aligned to published syllabi — they are not reproductions of Cambridge materials.

Any unauthorised copying, distribution, or use of our intellectual property may result in legal action.

9. Disclaimer of Warranties

Our materials are provided "as is" for educational support purposes. While we take care to ensure accuracy and alignment with relevant curricula, we make no warranties, express or implied, that:

Our materials will guarantee any specific examination result or grade
Our materials are 100% error-free (curricula change and we update materials periodically)
Our materials are officially endorsed by any examination board, government body, or educational authority
The Website will be uninterrupted, error-free, or free of viruses

We recommend using our materials alongside official textbooks, teacher guidance, and the current KICD or Cambridge curriculum designs.

10. Limitation of Liability

To the fullest extent permitted by Kenyan law, CBC Edu Kenya shall not be liable for:

Any direct, indirect, incidental, or consequential loss arising from the use of our materials or Website
Loss of data, device damage, or financial loss resulting from downloading our files
Any examination failure or poor academic performance
Errors or inaccuracies in our materials caused by subsequent curriculum changes
Any third-party payment processor failures (M-Pesa, Stripe, PayPal)

Our total liability to you for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.

11. Prohibited Use

You agree not to use the Website to:

Violate any applicable Kenyan or international law or regulation
Attempt to gain unauthorised access to any part of the Website or our systems
Transmit viruses, malware, or harmful code
Scrape, crawl, or systematically extract data from the Website without permission
Use automated means to purchase products for resale
Harass, abuse, or threaten our staff or other users
Submit false or fraudulent payment information
Infringe the intellectual property rights of CBC Edu Kenya or third parties

Violation of these prohibitions may result in termination of access to the Website and, where appropriate, legal action.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the Kenyan courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.
